These Terms of Use (“Terms”) govern your access to and use of Fastby AI, including our website, applications, AI image generation tools, image editing tools, subscription features, credit-based features, and related services (collectively, the “Service”).

The Service is provided by piece of cake LLC (“Fastby AI,” “we,” “us,” or “our”).

By accessing or using the Service, creating an account, generating or editing images, purchasing a subscription, purchasing or using credits, or otherwise using any part of the Service, you agree to these Terms. If you do not agree to these Terms, you must not use the Service.

These Terms should be read together with our other policies, including our Privacy Policy, Refund Policy, and disclosure page under the Act on Specified Commercial Transactions, where applicable.

1. Overview of the Service

Fastby AI provides AI-powered image generation and image editing tools, which may include:

• •Text to Image
• •Image to Image
• •Background Remover
• •Image Upscaler
• •model-based image generation
• •other AI-powered creative tools that we may add from time to time

The Service may allow you to submit text, prompts, images, settings, parameters, and other materials (“Inputs”) and receive generated, edited, enhanced, transformed, or processed results (“Outputs”).

The Service may use third-party AI models, APIs, cloud infrastructure, payment processors, analytics tools, advertising tools, and other service providers in order to operate and provide the Service.

We may add, modify, suspend, replace, restrict, or discontinue any part of the Service, including tools, models, features, plans, credit packages, and pricing, subject to applicable law.

2. Eligibility

You may use the Service only if you are legally able to enter into a binding agreement.

You represent and warrant that:

• •you are at least 18 years old or the age of majority in your jurisdiction; or
• •if you are under the age of majority, you have permission from your parent or legal guardian to use the Service.

You may not use the Service if you are prohibited from doing so under applicable law, sanctions, export control rules, or these Terms.

3. Accounts

You may need to create an account to access certain features.

You are responsible for:

• •providing accurate and current account information;
• •maintaining the confidentiality of your login credentials;
• •all activity that occurs under your account; and
• •promptly notifying us if you suspect unauthorized access to your account.

We may suspend, restrict, or terminate your account if we reasonably believe that you have violated these Terms, abused the Service, created risk for other users or the Service, failed to pay applicable fees, or used the Service in an unlawful, fraudulent, or harmful manner.

4. Plans, Usage Limits, and Credits

Fastby AI may offer free features, paid subscription plans, credit-based features, paid models, and other pricing options.

Current plan details, prices, and available features are displayed on the Service, including the pricing page and checkout screens. If there is a conflict between these Terms and the specific pricing or feature details shown at checkout, the checkout information will apply to that purchase, unless prohibited by applicable law.

4.1 Free Plan

The Free plan allows you to try supported features of the Service without a paid subscription.

The Free plan currently includes up to three (3) completed generations per day in total.

This daily limit is shared across supported tools, including:

• •Text to Image
• •Image to Image
• •Background Remover
• •Image Upscaler

The Free plan limit is not three (3) generations per tool. It is three (3) completed generations per day in total across supported generation and image editing tools.

Certain models, features, sizes, quality settings, or providers may require credits even on the Free plan.

4.2 Professional Plan

The Professional plan is a paid subscription plan.

The Professional plan currently provides access to supported standard features with no daily generation limit for standard models, subject to these Terms, fair use, technical limitations, provider limitations, and abuse prevention measures.

The Professional plan does not mean that all models, all features, or all usage are free of additional credit requirements.

Premium, paid, high-cost, third-party, experimental, or otherwise designated models may require credits even if you are subscribed to the Professional plan.

4.3 Paid Models and Credits

Some models or features require credits.

Credits may be required regardless of whether you are using the Free plan or the Professional plan.

The number of credits required may vary depending on the model, feature, provider, size, quality setting, generation type, processing cost, or other factors.

When credits are required, the required credit amount will be displayed before generation.

By starting a generation that requires credits, you authorize us to deduct the required credits from your credit balance when the generation is successfully completed.

4.4 Credit Consumption

Credits are generally consumed when a generation is successfully completed.

If a generation fails due to a system error, provider error, or technical failure, credits should generally not be deducted for that failed generation. If credits are deducted due to an error, please contact us.

Credits may still be consumed if a generation is successfully completed but the Output does not meet your subjective expectations, preferences, commercial needs, aesthetic preferences, or intended use.

We may maintain records of credit purchases, credit grants, credit usage, credit deductions, and related transactions for account management, fraud prevention, support, compliance, and service operation.

4.5 Nature of Credits

Credits are not currency, stored value, electronic money, crypto-assets, securities, or financial instruments.

Credits:

• •may be used only within the Service;
• •have no cash value;
• •are not transferable unless we expressly allow it;
• •cannot be exchanged for cash;
• •cannot be used outside the Service;
• •may be subject to expiration, limits, or conditions if stated at the time of purchase or grant; and
• •may be revoked, adjusted, restricted, or removed if obtained through fraud, abuse, chargeback, error, violation of these Terms, or misuse of the Service.

5. Subscriptions, Payments, and Billing

Paid subscriptions and credit purchases may be processed by third-party payment processors.

By purchasing a subscription, credits, or any paid feature, you agree to pay all applicable fees, taxes, and charges shown at checkout.

Subscriptions may renew automatically unless canceled before the renewal date. You are responsible for managing and canceling your subscription before renewal if you do not wish to be charged for the next billing period.

Detailed refund rules are provided in our Refund Policy. To avoid duplication, these Terms do not restate the full Refund Policy.

Information required under the Act on Specified Commercial Transactions, where applicable, is provided on our separate disclosure page.

6. User Inputs

You retain any rights you may have in your Inputs.

You represent and warrant that you have all rights, licenses, permissions, and consents necessary to upload, submit, process, transform, edit, and use your Inputs through the Service.

You must not submit Inputs that:

• •infringe or violate intellectual property rights, privacy rights, publicity rights, image rights, personality rights, or other rights of any person or entity;
• •contain unlawful, harmful, abusive, exploitative, or prohibited content;
• •contain confidential, sensitive, or personal information that you are not authorized to process;
• •violate any applicable law, platform policy, third-party terms, or these Terms.

You are solely responsible for your Inputs and for ensuring that your use of the Service complies with applicable laws and third-party rights.

7. License to Operate the Service

By submitting Inputs or using the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, transmit, display, modify, create derivative works from, and otherwise use your Inputs and Outputs solely as necessary to:

• •provide, operate, maintain, and improve the Service;
• •generate, edit, process, store, and display Outputs;
• •provide customer support;
• •process payments, credits, usage limits, and account status;
• •detect, prevent, investigate, and respond to fraud, abuse, security incidents, and policy violations;
• •comply with applicable law;
• •enforce these Terms.

This license does not transfer ownership of your Inputs to us.

Personal information is handled as described in our Privacy Policy.

8. Outputs and Commercial Use

Subject to these Terms, applicable law, and any applicable third-party model or provider terms, you may use Outputs for personal or commercial purposes.

To the extent we have any rights in Outputs generated specifically for you through the Service, we assign to you our right, title, and interest in those Outputs, subject to these Terms and your compliance with them.

However, you understand and agree that:

• •Outputs may not be unique;
• •the same or similar Outputs may be generated for other users;
• •Outputs may be inaccurate, incomplete, unexpected, offensive, biased, or unsuitable for your intended use;
• •we do not guarantee that any Output is copyrightable;
• •we do not guarantee that you will have exclusive rights in any Output;
• •we do not guarantee that any Output will not infringe or violate third-party rights;
• •we do not provide copyright, trademark, publicity rights, privacy rights, advertising, or other legal clearance for Outputs;
• •you are responsible for reviewing Outputs before using, publishing, distributing, selling, or commercializing them;
• •you are responsible for ensuring that your use of Outputs complies with applicable laws, regulations, platform policies, and third-party rights.

Commercial use of Outputs is permitted only if your use complies with these Terms and applicable law.

9. Third-Party Models and Providers

The Service may use, connect to, or make available third-party AI models, APIs, platforms, infrastructure, or other third-party services.

Some models or features may be provided by third parties or may be subject to separate licenses, usage policies, restrictions, or additional terms.

You are responsible for complying with any applicable third-party model terms, licenses, provider policies, or usage restrictions that apply to your selected model, feature, or provider.

We do not control all third-party models, providers, infrastructure, or services. We are not responsible for their availability, performance, security, accuracy, restrictions, legality, licensing terms, or outputs, except to the extent required by applicable law.

We may remove, restrict, replace, or modify access to any model, provider, or feature at any time.

10. Prohibited Uses

You may not use the Service, Inputs, Outputs, credits, accounts, or any part of the Service for any unlawful, harmful, abusive, deceptive, or prohibited purpose.

Without limitation, you must not use the Service to create, upload, generate, edit, distribute, or promote content or activity that falls within any of the categories below.

10.1 Illegal, Harmful, or Abusive Activity

You must not use the Service to:

• •violate any applicable law or regulation;
• •facilitate fraud, scams, phishing, identity theft, impersonation, or deceptive practices;
• •promote, support, or facilitate violence, terrorism, extremist activity, organized crime, or physical harm;
• •generate instructions for wrongdoing, evading law enforcement, or causing harm;
• •create or distribute malware, harmful code, security exploits, or cyber abuse.

10.2 Intellectual Property and Rights Violations

You must not use the Service to:

• •infringe or misappropriate copyrights, trademarks, trade secrets, design rights, or other intellectual property rights;
• •misuse protected characters, logos, brands, artworks, products, or designs without authorization;
• •violate privacy rights, publicity rights, image rights, personality rights, or similar rights;
• •impersonate another person or falsely suggest endorsement, sponsorship, or affiliation.

10.3 Sexual, Exploitative, or Abusive Content

You must not use the Service to create or distribute:

• •child sexual abuse material or any sexual content involving minors;
• •content that sexualizes minors;
• •non-consensual intimate imagery;
• •sexual exploitation, human trafficking, or abuse;
• •extreme gore, torture, or graphic abuse in a harmful or exploitative manner.

10.4 Harassment, Hate, and Discrimination

You must not use the Service to:

• •harass, threaten, bully, stalk, or abuse individuals or groups;
• •promote hatred, discrimination, dehumanization, or violence based on protected characteristics;
• •create defamatory, malicious, or targeted abusive content about a person or entity.

10.5 Deceptive or Misleading Uses

You must not use the Service to:

• •create misleading synthetic media, deepfakes, fake endorsements, fake reviews, or false evidence;
• •deceive others into believing that AI-generated content is real, human-generated, or officially endorsed where that would be misleading or unlawful;
• •generate misleading advertising, misinformation, or manipulative public-interest content;
• •impersonate a real person without appropriate rights, consent, or lawful basis.

10.6 High-Risk Uses

You must not use the Service or Outputs as a substitute for professional advice, judgment, or decision-making in high-risk areas, including:

• •legal advice;
• •medical advice;
• •financial advice;
• •employment, credit, housing, insurance, or eligibility decisions;
• •biometric identification or sensitive profiling;
• •law enforcement, surveillance, or public safety decisions;
• •safety-critical systems, emergency systems, or infrastructure operation.

10.7 Abuse of the Service

You must not:

• •bypass usage limits, credit requirements, payment systems, rate limits, or access controls;
• •create multiple accounts to evade limits or obtain additional free usage;
• •automate bulk generation, scraping, resale, or account creation without our written permission;
• •resell, sublicense, or provide the Service as a competing service;
• •reverse engineer, copy, extract, or attempt to access non-public models, systems, prompts, source code, or data;
• •interfere with the security, performance, integrity, or availability of the Service;
• •use the Service in a way that creates excessive load, cost, abuse risk, security risk, or operational risk.

We may block, remove, restrict, or refuse to process any Input, Output, account, model request, or activity that we believe violates these Terms or creates legal, safety, reputational, operational, or business risk.

11. Fair Use, Rate Limits, and Abuse Prevention

Even where a plan is described as “unlimited,” the Service remains subject to fair use, technical limits, provider limits, rate limits, credit requirements, abuse prevention systems, and reasonable operational restrictions.

We may limit, throttle, suspend, or restrict access if we reasonably believe that your usage:

• •harms or degrades the Service;
• •creates excessive cost, load, or risk;
• •violates these Terms;
• •attempts to bypass credit or usage limits;
• •indicates fraud, abuse, automation, scraping, resale, or unauthorized commercial exploitation;
• •may expose us, our users, our providers, or third parties to legal, security, operational, or reputational risk.

Professional plan access is intended for ordinary individual or business use, not automated high-volume generation, resale, scraping, or infrastructure-level use unless we expressly agree in writing.

12. Storage and Availability of Content

The Service may store Inputs, Outputs, generation history, metadata, account information, usage records, credit transactions, and billing-related records as necessary to operate the Service, manage accounts, provide support, prevent abuse, enforce these Terms, and comply with applicable law.

We do not guarantee that Inputs, Outputs, generation history, files, or account data will be stored permanently.

You are responsible for downloading and backing up any Outputs you wish to keep.

We may delete, restrict, or disable access to Inputs, Outputs, records, or accounts where required by law, requested by you, necessary for security, necessary to operate the Service, or necessary to enforce these Terms.

13. Privacy

Our collection and use of personal information is described in our Privacy Policy.

To avoid duplication, these Terms do not restate the full Privacy Policy.

You should not submit sensitive personal information, confidential information, trade secrets, regulated information, or personal data of others unless you have the legal right to do so and understand the risks.

14. Fastby AI Intellectual Property

The Service, including software, interfaces, designs, features, logos, trademarks, text, graphics, workflows, documentation, and other materials provided by Fastby AI, is owned by us or our licensors.

Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works based on the Service or any part of it.

Nothing in these Terms grants you any rights in our trademarks, logos, domain names, software, models, systems, or proprietary technology.

15. Feedback

If you provide feedback, suggestions, ideas, bug reports, or recommendations about the Service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, distribute, display, and otherwise exploit that feedback without restriction or compensation to you.

16. Third-Party Links and Services

The Service may contain links to third-party websites, services, models, tools, platforms, payment processors, or other resources.

We are not responsible for third-party websites, services, content, terms, policies, availability, security, or practices.

Your use of third-party services may be subject to separate terms and privacy policies.

17. Service Changes, Suspension, and Termination

We may modify, suspend, or discontinue the Service, any feature, any model, any plan, any credit package, or any part of the Service at any time, subject to applicable law.

We may suspend, restrict, or terminate your account or access to the Service if:

• •you violate these Terms;
• •you fail to pay applicable fees;
• •your payment is disputed, reversed, or subject to chargeback;
• •you abuse credits, usage limits, plans, or promotional offers;
• •your use creates legal, security, financial, operational, or reputational risk;
• •we are required to do so by law or by a third-party provider;
• •we discontinue the Service or relevant features.

You may stop using the Service at any time.

Termination does not affect any rights or obligations that by their nature should survive termination, including payment obligations, disclaimers, limitations of liability, indemnification, and dispute provisions.

18. Disclaimers

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, reliability, and uninterrupted operation.

We do not warrant that:

• •the Service will be error-free, secure, uninterrupted, or available at all times;
• •Outputs will be accurate, complete, lawful, non-infringing, unique, copyrightable, or suitable for your intended use;
• •any model, provider, feature, tool, plan, or credit package will remain available;
• •any generation will meet your expectations;
• •any errors or defects will be corrected;
• •any Inputs, Outputs, files, or account data will be preserved permanently.

You use the Service and Outputs at your own risk.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Fastby AI, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, business opportunities, or business interruption, arising out of or related to your use of or inability to use the Service.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or related to these Terms or the Service will not exceed the greater of:

• •the amount you paid to us for the Service during the three (3) months before the event giving rise to the claim; or
• •USD $100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the maximum extent permitted by law.

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Fastby AI, its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• •your Inputs or Outputs;
• •your violation of these Terms;
• •your violation of applicable law;
• •your violation of third-party rights;
• •your commercial use of Outputs;
• •your misuse of credits, plans, payment systems, or usage limits;
• •your fraud, abuse, or unauthorized use of the Service.

21. Rights Complaints

If you believe that content generated, uploaded, or made available through the Service infringes your copyright, trademark, publicity rights, privacy rights, image rights, personality rights, or other rights, please contact us at: support@fastby.ai

Your notice should include:

• •your name and contact information;
• •identification of the work, content, person, brand, or right that you claim has been infringed;
• •identification of the content or activity you believe is infringing;
• •a statement explaining why you believe the content or activity violates your rights;

• •your physical or electronic signature.

We may remove, restrict, disable, investigate, or take other action regarding content, accounts, or activity in response to rights complaints, legal requests, or policy violations.

We may terminate accounts of users who repeatedly infringe or violate third-party rights.

22. Legal Compliance

You are responsible for using the Service in compliance with all applicable laws and regulations, including intellectual property laws, privacy laws, consumer protection laws, advertising laws, export control laws, sanctions rules, and platform policies.

You may not use the Service in any country, region, or manner prohibited by applicable law.

23. Changes to These Terms

We may update these Terms from time to time.

When we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms on the Service, updating the “Last updated” date, or providing notice through the Service or by email.

Your continued use of the Service after the updated Terms become effective means that you accept the updated Terms.

If you do not agree to the updated Terms, you must stop using the Service.

24. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan, without regard to conflict of law principles.

Unless otherwise required by applicable law, the Tokyo District Court will have exclusive jurisdiction as the court of first instance over any dispute arising out of or related to these Terms or the Service.

If you are a consumer in a jurisdiction where mandatory consumer protection laws apply, nothing in these Terms limits any rights you may have under those mandatory laws.
